Affiliate Agreement

Enrollment is automatic — your account, referral code, and link are active as soon as you sign up, with no review period. You must provide accurate information, be legally able to enter a contract, and be at least 18 years old. We may suspend or terminate an account at any time, including for any breach of Section 7 (see Section 9).

You receive a unique referral code and link. When a visitor arrives through your link, we store a first-party cookie identifying you for 60 days. If that visitor subscribes within the window, the customer is attributed to you on a last-clickbasis (the most recent affiliate link clicked wins). A customer may also enter your code manually at checkout. Attribution is final once a referred customer's first payment is recorded and, for a customer already attributed to another affiliate, cannot be reassigned.

You earn 20% of the amount actually paid (net of any discount, taxes, and refunds) on every payment made by a referred customer for 12 monthsfrom that customer's first payment — the initial purchase and each renewal within the window. After 12 months the referral stops earning. Commissions are recorded in your dashboard as they accrue.

Each commission is held for 45 daysafter it is earned before it is "cleared" and eligible for payout. This covers the refund and chargeback window. If the underlying payment is refunded, disputed, or charged back at any time, the corresponding commission is reversed; if it was already paid to you, we may deduct the amount from future commissions or invoice you for it.

Payouts are made monthly for cleared commissions, provided your cleared balance is at least $50. Balances below $50 roll over. You must supply a valid PayPal email or Venmo handle; we are not responsible for payments sent to an incorrect address you provided. You are responsible for all taxes on commission income. US-based affiliates earning $600 or more in a calendar year must provide a completed IRS Form W-9 and will be issued a Form 1099-NEC. Unclaimed balances on a closed account are forfeited after 12 months.

Referred customers receive 20% off their first payment — one month or one annual term, whichever they purchase first. On a plan that starts with the $1 trial, the discount applies to the first full plan charge after the trial converts. The discount applies to the first purchase only and once per customer; it cannot be reapplied on a later purchase, renewal, plan change, or after cancelling and resubscribing, and it does not stack with other offers.

You may promote Fast Snap Pro through your own website, videos, newsletter, social accounts, trade groups, courses, and honest reviews. You may not:

• bid on "Fast Snap Pro" or confusingly similar terms in paid search, or use them in ad display URLs;
• list your code on coupon, deal, or cashback sites, or represent it as an official public discount;
• refer yourself, your own accounts, or people acting on your behalf;
• use spam, unsolicited messaging, misleading claims, fake reviews, cookie stuffing, or automated/incentivized clicks;
• impersonate Fast Snap Pro or Hypersmarty, or imply an employment or partnership relationship beyond "affiliate";
• register domains or social handles containing our brand.

Commissions from activity that breaches this section are void.

We grant a limited, revocable, non-exclusive license to use the Fast Snap Pro name and logos solely to promote the Service under this Agreement, following any brand guidelines we provide. All goodwill from that use belongs to us.

Either party may end this Agreement at any time for any reason. On termination your referral links stop earning. Cleared commissions above the minimum are paid on the next cycle; we may withhold payment where we reasonably believe fraud or a material breach has occurred. Sections 4, 5, 10, and 11 survive termination.

We may change commission rates, the discount, cookie duration, the holding period, the payout minimum, or any other term on 30 days' notice by email or dashboard notice. Changes apply going forward; commissions already earned are unaffected. Continued participation after a change is acceptance of it.

The Program is provided "as is." To the maximum extent permitted by law, our total liability under this Agreement is limited to the commissions paid or payable to you in the 6 months before the claim. We are not liable for indirect or consequential losses, including lost profits or anticipated commissions.

You are an independent contractor. Nothing here creates an employment, partnership, agency, or joint-venture relationship. This Agreement is governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws rules. If a provision is unenforceable, the rest remains in effect.
